2. This is the second bail petition of petitioner after rejection of his earlier petition through Cr. Misc. No. 68213 of 2021 vide order dated 25.07.2022. It is submitted that the specific direction was given through aforesaid order as to conclude trial within 6 months, even despite of that only 2 charge-sheeted witnesses were examined till date and, as such, conclusion of trial is a remote aspect, where petitioner is in custody since 17.08.2021, being lady.
3. Learned APP submitted that no fresh material is available to reconsider the prayer of bail except custody period.
4. Considering the facts and circumstances as mentioned above, as petitioner is in custody since 17.08.2021, where trial is not likely to conclude in near future, accordingly, above named petitioner is directed to be released on bail in connection with Madhaura P.S.
Patna High Court CR. MISC. No.28987 of 2023(5) dt.02-08-2023 2/2 Case No. 473 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-XIII, Chapra at Saran/concerned court, subject to the conditions as mentioned under Section 437 (3) of the Cr.P.C.
