2. The petitioner seeks bail in a case registered for offence under Section 376(G) of the Indian Penal Code.
3. The informant, namely Ramawati Devi, alleged that on 22.10.2023 at about 11:30 PM, while her daughter was returning from fair, this petitioner and co-accused Deepak Kumar @ Badri caught hold of her and took her into a bush and thereafter, this petitioner committed rape upon her. The accused persons also threatened her not to disclose the ordeal to anyone.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case at the instance of Binod Ray, who is uncle of the petitioner, with whom, a dispute regarding partition of house is going on and informant Ramawati Devi is sister of said Binod Ray. He further submits

No.19363 of 2025(3) dt.12-09-2025 2/2 that victim is 19 years old and as per medical report, she was pregnant prior to the alleged occurrence and no evidence of recent sexual intercourse was found. Petitioner has got clean antecedent and is in custody since 10.12.2024. Charge has already been framed and witnesses are being examined.
5. Learned A.P.P. for the State opposed the bail petition.
6. Considering the period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Chapra, District - Saran in connection with Sessions Trial No. 186 of 2025, arising out of Marhowrah P.S. Case No. 676 of 2023.
