Petitioner seeks bail in a case registered for the offences under Section 399, 402 of the I.P.C. and Sections 25(1b)a/26/35 of the Arms Act. Petitioner is in jail custody since 06.01.2016 on the accusation that one country made pistol was recovered from his conscious possession when he was caught by the police while making preparation for committing dacoity. Moreover having more or less similar allegation co-accused, from whose house the petitioner was arrested, has already been granted privilege of bail.
