JUSTICE RAJAN GUPTA) 03-02-2022 The present writ petition has been filed for directing the respondents, more particularly, the Sub Divisional Officer, Marhourah, District-Saran to consider the case of the petitioner in light of the observation made by the Patna High Court vide order dated 13.04.2017, passed in C.W.J.C. no. 16947 of 2015. At this stage, the learned counsel for the respondent- State has pointed out that the Collector, Saran, vide order dated 25.06.2019, passed in Supply case no. 14 of 2014, had remanded the matter back to the Sub Divisional Officer, Marhourah (Saran) for passing a fresh order in accordance with law. It is submitted that thereafter, considering the order passed
Patna High Court CWJC No.9042 of 2021(3) dt.03-02-2022 2/2 by the Patna High Court dated 13.04.2017 as also the order dated 25.06.2019 passed by the learned Collector, Saran, a case bearing case no. 06 of 2021 was initiated by the Sub Divisional Officer, Marhaura and then by a reasoned and a speaking order dated 28.06.2021, the license of the P.D.S. shop of the petitioner has been restored. It is thus submitted that the grievance of the petitioner has stood redressed.
In such view of the matter, the learned counsel for the petitioner seeks not to press the present petition, however with liberty to the petitioner to approach the concerned authority, in case of any subsisting grievances.
Accordingly, we disposed off the present writ petition as not pressed, however with the aforesaid liberty. (Rajan Gupta, J) ( Mohit Kumar Shah, J) rinkee/- U
