The petitioner in Criminal Miscellaneous No. 37802 of 2015, is the elder brother-in-law of the deceased lady and the petitioners in Criminal Miscellaneous No. 38417 of 2015 are father-in-law and mother-in-law respectively of the deceased who

Patna High Court Cr.Misc. No.37802 of 2015 (3) dt.22-12-2015 2/3 is said to have married their son. Learned Counsel for the petitioners submits that earlier the diary in the present case was called for on 29.09.2015 by a Bench of this Court. The case of husband of the deceased was also under consideration and after considering all the facts and circumstances, this Court in Criminal Miscellaneous No.38041 of 2015 vide order dated 22.09.2015, has been pleased to extend the privilege of pre arrest bail to the husband, Sonu Yadav. Learned Counsel for the petitioners submits that these petitioners were in fact having no concern with the deceased lady as they were living separately.

Considering the facts and circumstances and also that the husband of the deceased in the present case has already been extended the privilege of anticipatory bail, let the petitioner Sharwan Yadav in Cr. Misc No. 37802 of 2015 and petitioners Chandeshwar Yadav and Usha Devi in Cr. Misc No. 38417 of 2015, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S.
