The petitioner apprehends his arrest in connection with Alauli P.S. Case No. 158 of 2014 registered under Sections 366(A), 367, 376, 34 of the Indian Penal Code. The accusation is of kidnapping the daughter of the informant aged about 16 years by this petitioner with the help of Usha Devi, Gulo Yadav, Meena Devi, Sanju Devi, Sanjay Yadav, Rubi Devi, Pradip Yadav, Ram Kumar Yadav. Learned counsel appearing on behalf of the petitioner submits that in fact the daughter of the informant fell in love with this petitioner and left her house according to her sweet will and also performed marriage with this petitioner at Karnal.
Patna High Court Cr.Misc. No.2505 of 2017 (2) dt.03-03-2017 2/2 This fact has also been stated by the victim in her statement recorded under Section 164 Cr.P.C. However, the victim has also stated in her 164 Cr.P.C statement that she came to know after some time that this petitioner used to carry the girls and sale and thereafter she informed to her Nana. It is further submitted that victim has also filed a petition before learned Court below on 04.11.2015 to the effect that she has performed marriage with this petitioner, they are leading a conjugal life and she does not want to proceed with the case.
Having considered the facts and circumstances of the case, let the petitioner above named, be released on anticipatory bail, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 158 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
