The petitioner seeks regular bail in connection with Forbesganj PS case no. 440 of 2018 registered for the offence punishable under Sections 457, 380 of Indian Penal Code.
The allegation is regarding theft having been committed in the house of the informant by unknown miscreants and various articles including cash was taken away by the said miscreants.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the basis of confessional statement made by the co-accused person namely Chhotu Mandal who has already been granted
Patna High Court CR. MISC. No.18230 of 2019(2) dt.03-04-2019 2/2 bail by a coordinate Bench of this Court vide order dated 01.11.2018 passed in Cr. Misc. no. 58050 of 2018 and infact no recovery has been made from the possession of the petitioner. It is further submitted that the petitioner is languishing in custody since 31.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj PS case no. 440 of 2018.
