Petitioner seeks bail in a case registered for the offence punishable under Sections 392 and 398 of the Indian Penal Code and Section 27 of the Arms Act.

Informant in his written complaint has alleged that on 14.08.2021 at about 4:45 pm informant was sitting at the counter of his shop and in the North of his counter Dr. Yousuf was sitting. In the meantime two boys boarded on Apache motorcycle covering their face with mask armed with pistol came near the counter of his shop and demanded cash and when he denied he fired one shot and took cash of Rs. 1 Lakh from his counter and fled away. FIR is against unknown and according to FIR, three unknown persons were involved in the crime.

Patna High Court CR. MISC. No.20272 of 2022(2) dt.11-07-2022 2/2 Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere suspicion only. No incriminating material has been recovered from the possession of petitioner. Petitioner is not named in the FIR. The name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused. Petitioner has not been identified in CCTV footage. Petitioner had surrendered in Jadia P.S. Case No.24/2021 on 2.9.2021 and thereafter remanded in this case on 29.9.2021.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Tribeniganj P.S. Case No. 272 of 2021, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
