Patna High Court MJC No.1079 of 2019(4) dt.05-10-2023 2/2 155 of 2018 arising out of CWJC No. 10962 of 2017 which was dismissed for non-prosecution on 05.12.2018. For the reasons stated in the application for condonation of delay in filing MJC for about 63 days stands condoned.

3. Accordingly, I.A. No. 1 of 2019 stands allowed.

4. Heard MJC No. 1079 of 2019.

5. For the reasons stated in application and affidavit, MJC No. 1079 of 2019 stands allowed while recalling the order dated 05.12.2018 passed in LPA No. 155 of 2018 and restoring LPA No. 155 of 2018.

6. Registry is hereby directed to list the aforementioned LPA before the roster bench, subject to payment of cost of Rs. 2,000/- (Rupees Two Thousand Only). Cost shall be remitted in the Patna High Court Legal Services Committee within a period of four weeks' from today.
