JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
The present case was lodged on 12.09.2015 against unknown persons but after more than one and half months, two co-accused persons were arrested in connection with a case for an offence of Arms Act and made their confessional statement disclosing their involvement as well as petitioner in the present crime and on the basis of aforesaid confessional statement, the petitioner was made accused in this case. Moreover, co-accused Vikash Yadav and Ravi Prakash Gupta, who have confessed their
Patna High Court Cr.Misc. No.31231 of 2016 (2) dt.11-08-2016 2/2 guilt, disclosing the name of the petitioner have already been granted privilege of bail by co-ordinate Benches of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bhagalpur in connection with Sultanganj P.S. Case No. 198 of 2015, corresponding to G.R. No. 3372 of 2015.
