JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-04-2017 The learned counsel for the petitioner, the learned A.P.P. for the State and the learned counsel for the opposite party no.2 are present.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sohsarai P.S. Case No. 192 of 2016 for the offences punishable under sections 341, 323, 498 (A) and 504/34 of the I.P.C.

It is submitted on behalf of the petitioner that the petitioner is ready to pay Rs. 5,00,000/-, by way of one time settlement, to the opposite party no.2 within six months. The opposite party no.2 and her learned counsel are also ready on the said terms and the learned counsel submits that provisional bail may be granted to the petitioner till then.

No.2938 of 2017 (5) dt.12-04-2017 2/2 Under the circumstances, the petitioner is directed to pay Rs. 5,00,000/- within six months in the account of opposite party no.2 and after payment of full amount both parties will file compromise petition in all the cases so that the disputes may be ended once for all. Both parties will seek divorce with the mutual consent.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Nalanda at Bihar Sharif in connection with above mentioned case. After payment of full amount of Rs.5,00,000/- within six months the provisional bail granted to the petitioner shall be confirmed by the learned court below itself, failing which the bail granted shall be deemed to be cancelled. Accordingly, this Criminal Miscellaneous is hereby disposed of.
