Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner apprehends his arrest in Desari P.S. Case No. 11 of 2020, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
390 litres of foreign liquor is said to have been recovered from the poultry farm of this petitioner. It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner. The provision of section
Patna High Court CR. MISC. No.17755 of 2020(2) dt.11-06-2020 2/2 100 Cr.P.C has not been followed. The petitioner has got clean antecedent.
Considering the facts aforesaid and the fact that huge quantity of liquor has been recovered from the poultry farm of this petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
