The petitioner has renewed his prayer for bail in a case registered under sections 7(a) and (A) of the Prevention of Corruption Act.

It is submitted by learned counsel appearing for the petitioner that while rejecting the prayer for bail of the petitioner vide order dated 21.1.2022 passed in Cr. Misc. no. 39236 of 2021, this Court had granted liberty to the petitioner to renew his prayer for bail after framing of charge. Charge has been framed on 21.3.2022. The petitioner is in custody since 23.1.2021 and undertakes to cooperate in the trial. The application for bail is opposed by learned counsel appearing for the Vigilance.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the liberty granted by the aforesaid order of rejection dated 21.1.2022 and charges having been framed in the learned trial Court, the Court directs the petitioner to be enlarged on bail in connection with

Patna High Court CR. MISC. No.19267 of 2022(2) dt.13-04-2022 2/2 Special Vigilance P.S. Case no. 3 of 2021 (arising out of Vigilance P.S. Case no. 2 of 2021) on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance (Trap Cases), Bhagalpur subject to the following conditions :

(i) One of the bailers of the petitioner shall be a close relative of the petitioner.

(ii) The other bailor of the petitioner shall be resident of a place within the jurisdiction of the learned trial Court. (iii) The petitioner shall remain physically present in Court on each date of the trial.

In case of violation of any of the conditions laid above or in case the petitioner is not cooperating in the trial, the learned Trial Court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial. (Partha Sarthy, J) Prakash/- U
