2. The petitioner has preferred this application for grant of regular bail in connection with Panapur P.S. Case No. 103 of 2023 dated 19.05.2023 corresponding to G.R. No. 3958 of 2023 registered for the offence/s punishable u/s 304B read with section 34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

3. As per the prosecution case, the petitioner and the coaccused persons are alleged to have killed the informant's daughter due to non-fulfillment of demand of money and 20 grams of gold chain as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.18529 of 2025(2) dt.21-04-2025 2/2 case. The petitioner is the husband of the deceased. The petitioner neither demanded any dowry nor tortured the deceased. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner used to torture the deceased for dowry and strangulated her to death. The petitioner is the husband of the deceased. As per the postmortem report, the cause of death is Asphysia due to strangulation. It is further submitted that the marriage of the deceased was solemnized on 03.05.2023 and the occurrence took place within the period of 15 days i.e. on 18.05.2023.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected. (Chandra Prakash Singh, J) guddukr/- U T
