In this case, the petitioner is seeking anticipatory bail in connection with Amarpur P.S. Case No. 327 of 2018 registered for the offence under Sections 419 and 420 of the Indian Penal Code.

Allegation has been made that cleverly the petitioner took the A.T.M. card of the informant and withdrawn the money of Rs.65,700/-.

Learned counsel for the petitioner submits that the petitioner is ready to deposit the said amount before the Court below.

Looking to the nature of allegation, this Court is

Patna High Court CR. MISC. No.20895 of 2019(2) dt.04-04-2019 2/2 not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner deposits the aforesaid amount i.e. Rs.65,700/- before the Court below and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
