1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 69 of the BNS.
3. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that in sum and substance, the informant alleges that on pretext of false promise of marriage, the petitioner established physical relation and thereafter left her.
4. Learned counsel for the petitioner submits that

No.21726 of 2025(3) dt.15-05-2025 2/3 petitioner had advanced the sum of Rs.34,400/- as loan on behalf of SMFT India Credit on 08.07.2024 to the informant which was to be paid in installment as would manifest from Annexure-2 to the anticipatory bail application but since the informant was not paying the said loan amount as such a dispute had arisen and, accordingly, the instant false case came to be instituted. It is further submitted that informant is a married lady and has two children, as such, it cannot be presumed that without divorcing her first husband, the informant could have married the petitioner. It is next submitted that even presuming what has been alleged is true without admitting then the relationship was consensual and when such relationship sours, false allegation of establishing physical relation without consent is alleged.
5. Learned counsel appearing on behalf of the informant does not oppose the anticipatory bail application of the petitioner.
6. Learned A.P.P. for the State is present.
7. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.21726 of 2025(3) dt.15-05-2025 3/3 anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Majhaulia P.S. Case No. 746 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
