JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 272, 273 of the Indian Penal Code and 47(A) of Bihar Excise (Amendment) Act, 2016. Allegation in brief is that 25 kg. of mahua fruits and 2 litres of mahua wine were recovered from the house of the petitioner.

It is submitted that so many persons lived in the house of the petitioner. Since recovery is made from the house of the petitioner so his prayer for anticipatory bail is rejected. However, the petitioner may surrender before the court below and pray for regular bail which shall be considered on its own merit without being prejudiced by this order.
