None appeared on behalf of the State. Three petitioners, apprehending their arrest in Sheikhopursarai P.S. Case No. 63 of 2018 (POCSO Case No. 31 of 2018) registered for offence under Sections 363, 366(A) of the Indian Penal Code and Section 8 of the POCSO Act, have prayed for grant of bail, in the event of their arrest or surrender. At the very outset, it was submitted by learned counsel for the petitioners that daughter of the informant, who was major, had gone with Ram Ratan Kumar Paswan (son of petitioner no. 2 & 3) and her marriage was solemnized in a temple known as Ashok Dham, Lakhisari. It has been argued that the victim was examined by the Medical Board and her age
Patna High Court Cr.Misc. No.58646 of 2018(2) dt.20-09-2018 2/2 was assessed as 17-18 years.
Besides hearing, I have perused the material available on record as well as order impugned. Considering the facts and circumstances, particularly the fact that the victim was major, there is no reason to refuse the prayer for grant of anticipatory bail.
Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid three petitioners, namely, (i)Ranjana Kumari (ii)Bacho Devi (iii) Raja Ram Paswan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J., Sheikhpura in connection with Sheikhopursarai P.S. Case No. 63 of 2018 (POCSO Case No. 31 of 2018), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
