BAJANTHRI ORAL JUDGMENT Date : 17-02-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. Learned State counsel accepts notice for respondents. Learned counsel for the petitioner is hereby directed to furnish a copy of the petition to learned counsel for the State if it not already furnished.

In the instant petition, petitioner has prayed for the following relief(s):- "(i) For issuance of direction commanding the respondents to make payment of the regular monthly salary to the the petitioner, which is not being paid since December, 2016 due to non-

Patna High Court CWJC No.9291 of 2021 dt.17-02-2022 2/3 receipt of the L.P.C., service book etc. in the office of the Block Development Officer, Bairagania, which is kept illegally and malafidely by the Block Development Officer, Charaut, Sitamarhi. (ii) For initiation of departmental proceeding against the Block Development Officer, Charaut, Sitamarhi for illegally and petitioner in his custody, though the petitioner got his transfer in November, 2016 from there.

(iii) For payment of arrears of salary due since December, 2016 with interest at the rate of 16 % per annum and impose heavy cost for harassing the petitioner upto this Hon'ble Court.

(iv) For any other relief or reliefs for which the petitioner is found entitled in the facts and circumstances of the case and for the sake of justice."

In support of the aforesaid relief, the petitioner submitted a number of representations dated 27.09.2018, 28.01.2019, 06.01.2021 and 27.02.201 vide Annexure-1 to 4. Therefore, the concerned respondent is hereby directed to examine the petitioner's grievance relating to LPC, salary and other benefits which have been claimed by the petitioner. He is hereby directed to redress the grievance of the petitioner within a period of two months from the date of receipt of this order. If the petitioner is otherwise eligible the benefit of arrears of salary shall be extended. If the petitioner is not entitled in that event necessary

Patna High Court CWJC No.9291 of 2021 dt.17-02-2022 3/3 speaking order shall be passed and communicated to the petitioner. If the aforesaid direction is not complied within the time stipulated in that event the petitioner is entitled to litigation cost and it is quantified @ Rs. 10,000/-.

With the aforesaid observations, the present writ petition stands disposed off.
