It has been submitted on behalf of the petitioners that the petitioner No. 1 has been arrested during pendency of the anticipatory bail application.
Therefore, the prayer for anticipatory bail of the petitioner No. 1 stands dismissed as having become infructuous. The petitioner Nos. 2 and 3 apprehend their arrest in Chanan P.S. Case No. 129 of 2016 instituted for the offence under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code. There is allegation against petitioner Nos. 2 and 3 that they assaulted the mother of the informant with lathi and danda on
Patna High Court Cr.Misc. No.6110 of 2017 (3) dt.16-03-2017 2/2 the head causing bleeding injury.
Case diary has been received.
The learned A.P.P. has pointed out the injury report annexed with the case diary wherein the doctor has found lacerated wound 1/2" x 1/4" x skin deep which was simple in nature. From the injury report it appears that there is no repetition of blow. It further appears that there is general and omnibus allegation against the petitioner Nos. 2 and 3 who assaulted the mother of the informant on her head.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner Nos. 2 and 3 namely, Sunjeevan Kumar and Ranjeet Yadav is allowed. In the event of surrender/arrest of the petitioner Nos. 2 and 3, named above, within six weeks from today, in connection with Chanan P.S. Case No. 129 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Lakhisarai, subject to the conditions as laid down under Section 438 (2) Cr.
