2. The petitioner apprehends his arrest in Koransarai P.S. Case No. 120 of 2023 registered for the offences punishable under Sections 8(C), 21(b), 22(b) of the N.D.P.S..

3. As per the prosecution case, the allegation against the petitioner is that he has given Heroin like psychotropic substance to the co-accused Sushila Devi, who was caught red handed by the police along with 2.29 grams of Heroin.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that

Patna High Court CR. MISC. No.24037 of 2024(2) dt.24-04-2024 2/2 only on the basis of confessional statement of co-accused Sushila Devi, petitioner has been made accused in this case. The petitioner has three criminal antecedents out of which two antecedents are of similar nature as mentioned in para-3 of this application.

5. Learned APP for the State vehemently opposing the bail petition submitted that the petitioner is also involved in the present case.

6. Considering the facts and circumstances of case and the nature of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.
