The petitioner seeks bail in Turkauliya P.S. case No. 484 of 2018 registered under Section 272, 273, 34 of the Indian Penal Code and under Section 30 (a), 38(1), 41(1) of the Bihar Prohibition & Excise Act, 2016.
The S.H.O. Turkauliya in his own statement alleged that Dev Lal Das kept liquor at his pick up van and on such a raid was conducted. 11 drums each filled with 200 liter sprit were recovered behind the house and pick up van parked in front of house of Dev Lal Das.
It is submitted that petitioner is, of course, named in the FIR but he was not arrested on the spot. The name of petitioner
Patna High Court Cr.Misc. No.60007 of 2018 (2) dt.28-09-2018 2/2 figured in the disclosure made by Dev Lal Das. The petitioner has no manner of concern with the recovered articles. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran at Motihari in connection with Turkauliya P.S. case No. 484 of 2018.
