2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Vigilance P.S. Case no. 52 of 2019 instituted for the offence under Sections 420, 467, 168, 471, 120(B) of the Indian Penal Code and sections 13(2), 13(1)(D) of the Prevention of Corruption Act.

3. Allegation against the petitioner is of involving and committing irregularities in the process of appointment of 4th Grade Employees pursuant to an advertisement published in the year of 1999.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

Patna High Court CR. MISC. No.25469 of 2024(2) dt.04-04-2024 2/2 committed no offence. It is further submitted that the work was to be done by the District Magistrate and no by the petitioner. The petitioner is not responsible for any alleged wrong doing and except the name of the petitioner in FIR, there is no allegation against him of overwriting and manipulation in Answer sheet and tabulation chart. The petitioner has got no criminal antecedent. Moreover, similarly situated co-accused namely, Sadanand Sharma has already been granted bail by this Court vide order 3.1.2022 passed in Cr. Misc. No. 1516 of 2021.

5. Considering the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Vigilance P.S. Case no. 52 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance (Trap), Bhagalpur, subject to the conditions as laid down under section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Amandeep/- U T
