JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 447,341,342,323,324,504,307/34 of the Indian Penal Code. It is the submission on behalf of the petitioner that the families of the petitioner and the informant are on inimical terms because of land dispute and there is counter version of the same occurrence.

As per the prosecution story, over some petty dispute, the family members of the petitioner and the informant clashed. It is alleged that the petitioner assaulted the informant with Garasa and the accused persons took away a wrist watch and a cash of

Keeping in view the nature of dispute between the parties and the allegation against the petitioner and the submission that the injuries have not been found to be grievous in nature as also the fact that the petitioner has also no criminal antecedent, let the petitioner above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Darbhanga in connection with Bahera P.S. Case No. 207 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
