The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 324, 354, 379, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that over a trivial dispute relating to 'Nali', the six named accused persons including the petitioner herein came and started to abuse the informant and the members of her family. In course of dispute, the petitioner is said to have assaulted the informant as also her daughter with a khurpi.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case over a trivial dispute which would be evident from the FIR itself. He is
Patna High Court CR. MISC. No.19753 of 2022(3) dt.09-01-2023 2/2 in custody since 23.12.2021, chargesheet has been submitted in the case and he has no criminal antecedent.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation, the contents of the injury reports of the injured wherein the nature of injury is said to be simple, the petitioner being in custody for more than 1 year since 23.12.2021 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Khirhar P.S. Case no. 82 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Benipatti, District-Madhubani.
