Petitioner apprehends arrest in a case registered for the offences punishable under sections 304, 419, 420/34 of the Indian Penal Code.
The informant alleged that his wife was admitted in Kalpana Charitable Hospital, Dhansoi Road, Dinara. Chandan Kumar disclosed that operation would be done for removal of uterus of his wife. The informant alleged that petitioner Amit Kumar operated the wife of the informant with the help of Chandan Kumar but his wife died.
Learned counsel for the petitioner submits that Dr. Parminder Singh, MBBS, M.S. operated wife of the informant but from the photo copy of the certificates filed it appears to be
Patna High Court Cr.Misc. No.36618 of 2015 (3) dt.24-11-2015 suspicious. The I.O. also found the case true against the petitioner. The informant has also made allegation that it was the petitioner, who operated upon his wife causing his death. Petitioner has got no knowledge or degree to operate a patient. Having considered the facts aforesaid, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Dinara P.S. Case No. 171 of 2015 pending in the court of the learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas at Sasaram. His prayer for anticipatory bail is, accordingly, rejected.
