The petitioner seeks bail in a case registered under Section 380 of the Indian Penal Code.
Allegation is that unknown thieves committed theft in the house of the informant and took out cash of Rs.25,000/- and ornaments worth Rs.50,000/- etc.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.10.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. Neither any incriminating article has
Patna High Court CR. MISC. No.21334 of 2019(2) dt.08-05-2019 2/2 been recovered from the possession of the petitioner nor the petitioner has been put on T.I.P. Other co-accused has been granted bail vide Cr.Misc.No.68133 of 2018.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. case No.359 of 2018.
