16-08-2016 Heard Sri Vinay Kumar Mishra, learned counsel for the petitioner and Sri Navin Kumar Pandey, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 08-03-2016 in L.N.M.U. P.S. Case No. 63 of 2016 registered for the offence under Sections 393, 414, 420, 467, 468 & 120(B) of the Indian Penal Code and Sections 25(1-B)A, 26 & 35 of the Arms Act, 1959, has prayed for grant of bail, mainly on the ground that one of the co-accused namely Rahul Kumar Sahni, almost in similar circumstances, has been granted bail by a Bench of this Court on 28-04-2016, vide Cr. Misc. No. 17364 of 2016. Only difference of the petitioner's case is that from the possession of the petitioner, two live cartridges was recovered, whereas, from

Patna High Court Cr.Misc. No.31921 of 2016 (2) dt.16-08-2016 2/2 the possession of co-accused Rahul Kumar Sahni, one dagger as well as mobile sets were recovered.

However, keeping in view nature of accusation and period of custody, let the petitioner namely Sonu Sahni be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/concerned court in connection with L.N.M.U. P.S. Case No. 63 of 2016.
