JUSTICE BIRENDRA KUMAR ORAL ORDER 19-05-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 333, 353, 386, 379, 427, 504, 506, 120B of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage of Public Property Act.
The petitioners were members of the mob which attacked the police station with allegation that the police has allowed to go out Sahilendra Yadav a co-accused in a murder
Patna High Court Cr.Misc. No.5177 of 2017 (3) dt.19-05-2017 2/2 case. Further, allegation is of commission of brickbat causing injury to different police personnel including the informant as well as attempt to burn the police vehicle.
Since the petitioners are named in the FIR and nature of allegation, I am not inclined to grant anticipatory bail to the petitioners in connection with Manigachhi Police Station Case No. 14 of 2016 pending in the Court of learned Chief Judicial Magistrate, Darbhanga/successor Court.
Hence, prayer for bail is refused.
