The petitioner seeks bail in anticipation of his arrest in connection with Kudhani (O.P. Turki) P. S. Case No. 543 of 2018 dated 30.10.2018, instituted for the offences under Sections 364, 504, 34 and 302 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

Though the petitioner has been named in the F.I.R., but his implication in this case is only on the basis

Patna High Court CR. MISC. No.18996 of 2020(3) dt.09-10-2020 2/2 of suspicion. However, later during the course of investigation the complicity of the petitioner could be ascertained. A person was kidnapped and thereafter was killed.

Considering the aforesaid accusation against the petitioner, I am not inclined to grant anticipatory bail to him.

However, if the petitioner surrenders before the court below and prays for bail, the court below shall take into account all relevant facts and shall pass order in accordance with law, without being prejudiced by the fact that the present petition has not been entertained by this Court.

With the aforesaid observation / direction, this petition stands disposed off.
