JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bind P.S. Case No. 134 of 2014 registered under Sections 341, 323, 308, 325 and 504/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added.

The accusation is that on 21.12.2014 hot talk was exchanged between the informant/deceased with her sister-in-law, wife of the petitioner, in the evening. In that course, the petitioner started to abuse the informant/deceased and pushed her from the roof, on which, she fell down and suffered from pain in her waist and later on she died.

Patna High Court Cr.Misc. No.27857 of 2016 (2) dt.14-07-2016 Learned counsel for the petitioner submits that it would appear from the F.I.R. that the present case has been registered on the basis of written report of the informant/deceased, while she was suffering from pain in her waist but later on she died after one month and her dead body was disposed of but due to ulterior motive the present case has been lodged. It is further submitted that petitioner has no criminal antecedent and he is in custody since 22.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bind P.S. Case No. 134 of 2014. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
