The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 353, 283, 285 and 427 of the Indian Penal Code.

The prosecution case got initiated with the written report of Anjani Kumar, Police Inspector-cum- Station House Officer, Town P.S. Nawada dated 03.07.2018, to the effect that one Jitendra Pratap @ Jitu was arrested in Nawda P.S. Case No. 196 of 2017 and in protest of the same, Prajatantra

Patna High Court Cr.Misc. No.58040 of 2018 (2) dt.20-09-2018 Chowk was blocked by the accused persons and they not only blocked the traffic but also demanded release of Jitendra Pratap. On the basis of CCTV footage the FIR was lodged against 23 named and 108 unknown.

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against the mob and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is also named in the FIR.

Considering the accusation against the mob and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 446 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The learned Court below will positively cancel

Patna High Court Cr.Misc. No.58040 of 2018 (2) dt.20-09-2018 the bail bonds of the petitioner, if he gets involved in some similar nature of the offence.
