JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 395 and 412 of the Indian Penal Code. The name of the petitioner came in this case in confessional statement of co-accused and after that petitioner, too, confessed his guilt leading to recovery of one Samsung mobile phone from his house which is said to be looted property of present case.

Submission on behalf of the petitioner is that coaccused Lalan Paswan and some others have already been granted privilege of bail by different Benches of this Court and moreover,

Patna High Court Cr.Misc. No.33812 of 2016 (2) dt.18-08-2016 2/2 the so-called recovery from the house of the petitioner is nothing but only highhandedness of the police.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S. Case No.649 of 2015.
