JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier prayer for bail of the petitioner was dismissed twice vide order dated 18.07.2017 passed in Cr. Misc. No. 29205 of 2017 and vide order dated 07.03.2018 passed in Cr. Misc. No. 7462 of 2018 and there is allegation that petitioner and other accused persons came and started indiscriminate firing causing death of Sulekha Devi.
Submission of learned counsel for the petitioner that he has been in judicial custody since 01.05.2017 and other accused persons have been granted the privilege of bail vide order dated 02.01.2018 passed in Cr. Misc. No. 50892 of 2017 and vide order dated 21.03.2018 passed in Cr. Misc. No. 13596 of 2018. Further submission is that though it is alleged that six persons fired on the deceased but in the postmortem report only one injury was found on the dead body of the deceased.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IV, Rohtas at Sasaram, in connection with S. Tr. No. 309/2017, arising out of Bikramganj P.S. Case No. 84 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
