Altogether eleven persons are named as accused in the present case and it is said that co-accused Satendra Yadav fired on deceased and after that all the FIR named accused including petitioner started assaulting the deceased by means of iron pipe and lathi. The postmortem report of deceased goes to show that the deceased sustained altogether ten injuries said to be caused by hard and blunt substance and the aforesaid injuries became fetal to the deceased.
Submission on behalf of the petitioner is that having similar allegation co-accused Dahan Yadav, Pintu Yadav, Pappu Yadav, Ajit Yadav @ Ajit Kumar and Ashok Yadav have already been granted privilege of bail by coordinate Benches of
Patna High Court Cr.Misc. No.33701 of 2016 (3) dt.17-10-2016 2/2 this Court and so far as petitioner is concerned, his case is on similar footing to that of above stated co-accused persons because general and omnibus allegation of assault has been levelled against the petitioner. No doubt the alleged occurrence took place on 13.04.2014 and the petitioner has been remanded in this case on 21.04.2016 but taking note of the fact that having similar allegation other co-accused persons have already been granted bail and petitioner does not have any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Jigar Sah, Judicial Magistrate, Ist Class, Gaya in connection with Wazirganj P.S.Case No.158 of 2014.
