Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner seeks regular bail in connection with Mednichowki P.S. Case No. 45 of 2021 registered for the offence under Section 304(B)/34 of the Indian Penal Code. As per allegation, the informant's daughter was tortured by petitioner and his family members for the demand of Rs. one Lakh and thereafter on 26.3.2021 the informant was informed that his daughter had committed suicide and then the informant along with his family members rushed to his daughter's sasural and suspected that his daughter had been strangulated to death by the accused persons including the petitioner on account of their demand of dowry having been not fulfilled by the victim. No.20366 of 2022(2) dt.19-07-2022 2/2 the petitioner are that the allegation made in FIR is completely false, in fact the deceased was a literate woman while the petitioner is an illiterate person due to which the deceased did not like the petitioner and hence she committed suicide and at the time of alleged occurrence the family members of the petitioner including the petitioner were not present at their house and they were at their field and petitioner has been languishing in jail since 27.03.2021 Learned APP appearing for the State has opposed the bail prayer.
Heard both the sides and perused the FIR. As per allegation, the informant's daughter died in suspicious condition at her sasural and in the FIR the deceased's father made the allegation that the deceased was always subjected to torture by this petitioner and his family members for the demand of Rs. One lakh. The informant has made specific allegation of physical torture against the petitioner and his family members. In view of the nature of allegation appearing against the petitioner, this Court is not inclined to accept the prayer for bail of the petitioner. Accordingly his prayer for bail stands rejected.
