JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 15-09-2015 After having perused the position with regard to the transfer of the petitioner emerging from paragraph 4, 5, 6 and 7 of the counter affidavit of the State, the Court comes to a considered opinion that petitioner has not been truthful in stating facts in the writ application. He has deliberately misled the Court to believe that his transfers have been effected repeatedly and at short notice. A reading of the paragraphs in question noted above indicates the position fairly and squarely.

Since the petitioner has not approached the High Court with clean hands, not only the writ application is dismissed but a cost of Rs.10,000/- (rupees ten thousand) is awarded upon him, which will be deposited with the Legal Services Committee of the Patna High

Patna High Court CWJC No.11969 of 2015 dt.15-09-2015 2 / 2 Court within a period of four weeks.
