20-08-2016 Heard Sri Sanjay Kumar Pandey No. 5, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 16-06-2016 in Phulwaria P.S. Case No. 06 of 2016 (G.R. No. 106 of 2016) registered for the offence under Sections 341, 307 & 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail.

Learned counsel for the petitioner, by way of referring to F.I.R., submits that F.I.R. was lodged against unknown. Though, the F.I.R. was lodged in the month of January, 2016, almost after about five months, the same informant filed a written report before the Investigating Officer, in which, it was alleged that petitioner with her husband has hatched conspiracy to commit

Keeping in view the nature of accusation as well as the fact that petitioner is not named in the F.I.R. and petitioner is a lady, let the petitioner namely Asha Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Gopalganj in connection with Phulwaria P.S.
