JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Aurangabad (T) P.S. Case No.354 of 2018, disclosing offences under Sections 420 and 409 of the Indian Penal Code.

Petitioner happens to be the Work Manager and Supervisor of M/S Quess Corporation Limited which were allowed collecting the electricity bills from the consumers and it is alleged that the petitioner after collecting the money has misappropriated the amount of Rs. 10,31,171/- and not deposited the same to the South Bihar Power Distribution Company, Ltd.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.20816 of 2019(4) dt.20-06-2019 2/2 that petitioner has falsely been implicated in this case. However, after some arguments, learned counsel for the petitioner has submitted that he is ready to deposit the said amount if the reasonable time is given.

In such view of the matter, let the petitioner surrender before the court below within a period of eight weeks with a bank draft of Rs. 2,31,171/- issued in the name of South Bihar Power Distribution Company, Ltd. and on that he will release on provisional bail for a period of six months and during that period, he is to deposit the rest amount through bank draft in four equal installments. Once the whole amount is deposited by the petitioner, the bail bonds of the petitioner shall be confirmed.

It is also made clear that the aforesaid deposit would be the subject to the result of the case.
