Patna High Court CR. MISC. No.24808 of 2024(2) dt.24-04-2024 2/3 ORAL ORDER 24-04-2024 Heard learned counsel for the petitioners, informant and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.
3. It is alleged that when son of the informant was returning to his house, all the F.I.R. named accused persons including these petitioners obstructed his path with rope, assaulted him by means of knife and committed theft of Rs. 30,000/- cash and snatched away watch and golden chain.
4. It is submitted on behalf of the petitioners that though these petitioners are alleged to have assaulted the injured but the injured sustained only one injury on the cheek which was found to be simple in nature by the doctor.
5. Learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation and simple nature of injury, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
