====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the State. This application has been filed for modification of the order dated 24.8.2018 passed in Cr. Misc. 42220 of 2018. Counsel for the petitioner submits that petitioner was granted anticipatory bail by this Court by aforesaid order in which he was directed to surrender in the Court below within a period of six weeks from the date of order, but he could not surrender in the court below within stipulated time because the order was not properly communicated to the petitioner. The prayer has been made to extend time by further two weeks to surrender in the Court below.
This modification application is allowed with direction to petitioner to surrender in the court below within
Patna High Court CR. MISC. No.22350 of 2019(2) dt.17-04-2019 2/2 two weeks from the date of receipt/production of a copy this order. In the event petitioner surrenders in the court below within aforesaid period, he will be released on same terms and conditions as mentioned in the order dated 24.8.2018 passed in Cr. Misc. 42220 of 2018.
Let this order be communicated to the learned Judicial Magistrate, 1st Class, Sheikhpura, in connection with Karandey P.S. Case No. 57 of 2016.
