Learned counsel for the petitioner admits the event of negotiation as well as acceptance of cash as an earnest money to the extent of Rs. 2,88,000/-. However, disputed the amount Rs. 35,000/- dated 03.05.2009, Rs. 12,000/- dated 27.05.2009 and Rs. 8,000/- dated 11.06.2009 totaling Rs. 55,000/-. Learned counsel for the petitioner also submits that the petitioner is ready to deposit Rs. 2,88,000/-.

On deposit of Rs. 2,88,000/- in Complaint Case No. 4470(C) of 2013, pending before Miss Akansha Kashyap, J.M. Ist

Patna High Court Cr.Misc. No.42912 of 2014 (3) dt.01-07-2015 2 / 2 Class, Patna/successor in office within eight weeks from the date of production/receipt of the order, the petitioner, Kedar Rai will be released on bail in the event of arrest or surrender on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Miss Akansha Kashyap, J.M. Ist Class, Patna, successor in office in connection with Complaint Case No. 4470 (C) of 2013 in terms of conditions as enumerated under Section 438(2) of Cr. P.C.
