JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-05-2015 Heard learned counsel for the petitioner, learned counsel for the informant and also learned A.P.P. for the State. The petitioner apprehends her arrest in connection with Khajouli P.S. Case No. 143 of 2013 registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code. The dead body of Shiv Shankar Yadav, husband of informant, Rina Devi was found in Paswan Tola in the village. Thereafter the informant raised suspicion against the petitioner and Sohan Kumar in the murder of her husband saying that there was illicit relation between the petitioner and Shiv Shankay Yadv, husband of the informant.
Learned counsel for the petitioner submits that except suspicion there is no eye witness of the occurrence and due to
Patna High Court Cr.Misc. No.41885 of 2014 (4) dt.20-05-2015 illicit relation between the petitioner and the deceased, Shiv Shankar Yadav, informant has named this petitioner. It is further submitted that petitioner, who is the Surpanch of the village, has falsely been implicated in this case due to dirty village politics. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Madhubani, in connection with Khajouli P.S. Case No. 143 of 2013, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
