2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3 . It is alleged that 243 liters illicit liquor was recovered from Community Madarsa Diwari.

4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the alleged occurrence . Petitioner claims clean antecedent.

5 . Learned APP for the State vehemently opposed

6. Considering the facts of the case and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned special Judge Exclusive Excise Court No. 2 Sitamarhi in connection with Sursand P. S. Case No. 411 of 2020, subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
