JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363 and 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 5.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. There is admitted love affair between the petitioner and the victim. The victim has been recovered. They were in talking terms for a long time which was not liked by the parents. They have married each other. It is further submitted that petitioner may be released after completion of nine months in custody, i.e., from 5.4.2016.

On behalf of the State and the informant, it is submitted that the victim in her 164 Cr. P.C. statement has alleged that she was forcibly made to marry with the petitioner and after marriage she was assaulted by the petitioner and the parents of the

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody, i.e., from 5.4.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.S. Case no. 470 of 2015, G. R. no. 6727 of 2015.
