JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant. The petitioner apprehends his arrest in connection with Khajekalan P. S. Case No. 148 of 2016 instituted under Sections 327, 385, 354, 355, 420, 504 and 506/34 of the Indian Penal Code.
The allegation, in brief, is that the petitioner developed intimate relationship with the daughter of the informant, who was a student of Class-9th in the year 2013 and also took photograph with her, when the informant asked to return back those photographs and letters written by his daughter then the petitioner started threatening and blackmailing. Learned counsel for the petitioner submits that the petitioner and the daughter of the informant were in love affairs
Patna High Court Cr.Misc. No.6640 of 2017 (3) dt.18-03-2017 2/2 and she also used to write love letters to the petitioner, which is Annexure-2 of this bail application, and the photograph also shows that voluntarily their photograph was clicked and they were chatting for long period on Whats-App. so the allegation of blackmailing is false and only to put pressure to return back the photographs and love letters, this case was lodged and the petitioner is an Engineer and has no any criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Prince Aditya @ Prince, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Khajekalan P.S.Case No. 148 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
