Petitioner is languishing in judicial custody since 17.07.2018 in connection with Mahila P.S. Case No. 72/2018, G.R. No. 2339/2018 for offences punishable under Sections 341, 323 and 498-A of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that she is married to the petitioner since last 15 years and has two daughters and one son. On 19.05.2018, when a wrong number phone came on the mobile of the informant that there was certain altercation and the petitioner assaulted his wife, the informant, on which she received some injury on the head. It has been submitted by the learned counsel for the petitioner that he is innocent, no such occurrence had taken

Patna High Court Cr.Misc. No.59024 of 2018(2) dt.28-09-2018 2/2 place and the petitioner has committed no offence. He submits that he has kept his wife, the informant with full dignity and honour from the date of marriage since last 15 years and is ready to keep her with full dignity and honour. He further submits that no such allegation has been lodged prior to the present case by the informant and that the petitioner has no criminal antecedent.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs. 5,000/-(Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara, in connection with Mahila P.S. Case No. 72/2018, G.R. No. 2339/2018.
