JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 380 and 411 of the Indian Penal Code. Prosecution case is that informant sold his motorcycle to one Devendra Kumar but due to lack of time he could not transfer ownership of the motorcycle and that motorcycle was stolen. It has been submitted on behalf of the petitioner that he is in custody since 7.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. The stolen motorcycle is said to have been recovered from the house of the petitioner. Petitioner had no knowledge that the said motorcycle was a stolen one. It is further submitted that petitioner may be released after completion of six months in custody, i.e., from 7.4.2016.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six

Patna High Court Cr.Misc. No.33358 of 2016 (3) dt.22-09-2016 2/2 months in custody, i.e., from 7.4.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S. Case no. 65 of 2016, G. R. no. 763 of 2016.
