JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 364/34 of the Indian Penal Code.

Petitioner and one Dhanesh Kumar is said to have taken away victim who was, subsequently, recovered by the police. The statement of victim was recorded under Section 164 of the Cr. P. C. but the victim, at the very outset, stated in his statement that he was kidnapped by two persons but did not name the petitioner. One co-accused Dhanesh Kumar has already been granted privilege of bail by a co-ordinate bench of this court vide order dated 10.04.2019 passed in Cr. Misc. No.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Hilsa at Nalanda in connection with Karai Parashurai P.S.
