JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379, 427, 353 of the Indian Penal Code, Section 141 of Electricity Act and Section 3 of Prevention of Property Damage Act. Petitioner being member of trade union went on strike and in that course petitioner and other accused threw wire as a result of which function of insulator was stopped causing disruption of electric supply to several villages. It is also stated that petitioner and his associates snatched Rs. 2,000/- from the informant.
Patna High Court Cr.Misc. No.28611 of 2016 (2) dt.19-07-2016 2/2 Learned counsel for the petitioner submits that no specific overt-act has been attributed against the petitioner, who is languishing in jail custody since 13.06.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Siwan in connection with Mairwa P.S. Case No. 17 of 2016.
